Standard Warranty - Parts & Labour
All products manufactured by our suppliers are warranted by Ben Malta Limited to our customers against defects occurring in the manufacturing process, subject to the terms and conditions as stated in this warranty document.
Our Products are intended to be installed only by qualified personnel. Ben Malta Limited warrants its products to be free of manufacturing defects in material and in the working process, under normal use and service for which the product is intended and specified during the purchase agreement, for the period of 24 months from the date of installation. Remote controls and other hand held portable devices are only warranted for 12 months. There are no other warranties other than those stated here in.
The warranty only covers defects as stated here in and does not include defects or damages attributed to installation, misuse or normal surface weathering, or defects or damages caused by accident or fire or other causality or acts of god, or any other causes or occurrences beyond the manufacturer’s control.
The warranty is void if the item shows evidence of having been tampered with or show evidence of being damaged as a result of vandalism, power surge, moisture, vibrations, inappropriate use, misapplication, misuse, or excessive corrosion.
Every precaution for accuracy has been taken in the preparation of all documentation and manuals however Ben Malta Limited assumes no responsibility, for any omissions or errors that may appear. Nor does it assume liability for any damages or losses that result from the use of such documents, manuals or products in accordance with the information contained in the manual or software.
Warranty claims must be received by Ben Malta Limited within the applicable warranty period and within thirty (30) calendar days from the cause of the claim or when defect was discovered. Upon receipt of notice of warranty claim Ben Malta Limited shall have ten (10) working days in which to determine whether it acknowledges responsibility for any asserted defects in material or workmanship and the appropriate action to be taken.
For goods repaired under warranty, the warranty period of the newly replaced item is subsequent but continuous to the original defective replaced part’s warranty, thus the warranty of the newly replaced item is effectively 24 months from the date of original installation stated in the warranty document of the original purchase. Ben Malta Limited in no event assumes any liability for repairs or alterations made by other than Ben Malta Limited or its authorised resellers.
The Limited warranty and any claim arising from the breach of this warranty, or any other claim arising hereunder, shall be governed and construed under the laws of the Republic of Malta. No other person than Ben Malta Limited employees have any express or implied authority to bind Ben Malta Limited to any agreement or warranty of any kind.
Limitations of Liability
It’s understood and agreed that Ben Malta Limited’s liability, whether in contract, in tort under warranty, in negligence or otherwise, shall not exceed the return of the amount of purchase price for the defective item paid by the purchaser and under no circumstances shall seller be liable for special, indirect or consequential damages.
Ben Malta Limited in no event assumes any liability for damages to people or things caused by bad functioning of their installations. Ben Malta Limited is not responsible for any damages or losses caused to other equipment, whether direct, indirect, incidental, special or consequential which the purchaser may experience as a result of the installation or use of the product. Under no circumstances will Ben Malta Limited reimburse the claimant for loss incurred in removing or reinstalling any equipment.
The customer has no right to be refunded.
Monitoring Maintenance agreement
It is recommended that the purchaser contacts us to discuss and sign a contract of maintenance. The contract of maintenance must be stipulated between the purchaser and Ben Malta Limited directly on a case by case basis as special terms and clauses might apply to different installations. Extended warranty is also agreed upon and explained in the extended warranty agreement.
Extended Warranty - Parts only
The title of the document is “Terms and Conditions – Extended Warranty” and written and published as to explain solomly the terms and conditions for those who opt to buy the Extended warranty offer from BEN Malta limited. These terms are to be read and construed as one with the “Terms and condition – Standard Warranty”.
The Extended Warranty is offered by BEN Malta Limited against an agreed price depending on the type of installation and is only applicable once the extra payment is received and accepted by BEN Malta Limited. BEN Malta Limited reserves the right to cancel withdraw or reject an extension of warranty at it’s discretion and has no obligation to offer or accept the warranty extension.
The below stipulated amount of months for extended warranty is to be taken as calendar months of warranty over and above the standard warranty given by BEN Malta Limited as stipulated by Law and shall start to apply from the last day of the standard warranty, as stipulated and shown on the invoice / warranty document supplied from BEN Malta Limited after each installation. It is here well understood that no warranty neither standard nor Extended is valid unless the proper documentation is shown to BEN Malta Limited’s representatives as proof of purchase.
No other than an employee of BEN Malta Limited has the right to issue an extension of warranty.

All other peripherals such as Remotes / Safety photocells / External Keyswitches / Flashing Lights etc.. are guaranteed as per our Standard Warranty as explained in our Terms and Conditions - Standard Warranty. The Maximum Extended Warranty, whether integrated in the above mentioned model of motors or free standing for control boards in all cases and all installations is a maximum of twelve (12) months as indicated in the table above.
The extended warranty period for the above mentioned covers only internal mechanical or electrical parts of the motor and does not in any way cover, Discolouration / corrosion or superficial rust of the outer cover which does not impede on the correct functionality of the motor. The client must also cover the cost of labour for the replacement of the defective part by an authorised BEN Malta Limited employee, thus the extension of warranty covers “Parts only”.
